These Terms and Conditions set out the basis on which Rubbish Removal Harringay provides rubbish removal, waste collection, clearance and related services. By making a booking, confirming a quotation, or allowing our team to carry out any work, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order for any service.
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means any individual, company or organisation that requests or receives services from Rubbish Removal Harringay.
Services means any rubbish removal, waste collection, clearance, loading, transportation, disposal or related work carried out by Rubbish Removal Harringay.
Waste means any rubbish, refuse, junk, debris, household items, commercial waste or other materials that the Customer asks Rubbish Removal Harringay to remove, subject to applicable waste regulations.
Agreement means the contract between Rubbish Removal Harringay and the Customer, comprising these Terms and Conditions and any confirmed quotation or booking details.
Rubbish Removal Harringay provides waste collection and removal services for domestic and commercial customers. The specific scope of each service, including the type and approximate volume of waste, access requirements and any special instructions, will be agreed at the time of booking or quotation.
Our services are limited to the collection and disposal of waste as described by the Customer and accepted by us. We reserve the right to refuse to handle or remove any items that are hazardous, prohibited by law, or that our staff reasonably consider unsafe or inappropriate to move.
Bookings can be made by telephone, email, online enquiry or any other communication method we make available. At the time of booking, the Customer will be asked to provide accurate information about the property, the type and estimated volume of waste, any access restrictions and any special requirements.
We may provide either a fixed-price quotation based on the information supplied, or an estimate subject to confirmation on arrival once our team has inspected the waste. In some cases, we may need photographs or additional details before confirming the booking.
A booking will be considered accepted when we confirm the date, time window and indicative price, either verbally or in writing, and the Customer accepts these details. We may require a deposit or card details to secure the booking, which will be explained at the time of confirmation.
The Customer is responsible for ensuring that someone authorised is present at the property during the agreed time window to provide access, confirm the items to be removed and approve any changes to the scope or price of the service.
Prices will be based on factors including, but not limited to, the estimated volume and weight of waste, the type of materials to be collected, labour time, access conditions and disposal costs. We aim to provide clear and transparent pricing in advance of any work.
Where we provide an estimate based on information supplied prior to arrival, the final price may change if the actual volume, type of waste, or access conditions differ from what was described. In these circumstances, our team will explain any price adjustment before commencing work. If the Customer does not accept the revised price, we reserve the right to cancel the service or to perform only part of the service as agreed.
All prices will be stated inclusive or exclusive of VAT, as applicable, and this will be clarified at the time of quotation.
Unless otherwise agreed in writing, payment is due immediately on completion of the service. We may accept cash, card payment, bank transfer or other payment methods confirmed at the time of booking. For commercial customers, we may at our discretion offer credit terms, in which case the payment due date will be stated on the invoice.
We reserve the right to withhold removal of waste or to suspend services if full payment is not made when due. Where payment is not received by the agreed date, we may charge interest and reasonable recovery costs in accordance with applicable law.
Any disputes regarding invoices must be raised in writing within seven days of the invoice date. Failure to raise a dispute within this period may be treated as acceptance of the charges.
The Customer is responsible for:
Ensuring that all waste to be collected is clearly identified and accessible to our team at the agreed time.
Providing accurate information regarding the type, volume and location of waste, as well as any potential hazards.
Ensuring that access routes are safe, free from obstruction, and suitable for the movement of waste and the safe operation of vehicles and equipment.
Obtaining any necessary permissions, permits or approvals from property owners, landlords, managing agents or local authorities where required.
Not placing in the waste any items that are hazardous, illegal or otherwise prohibited under relevant waste regulations, unless specifically agreed with us in advance and in compliance with applicable law.
If our team is prevented from carrying out the service due to inaccurate information, lack of access, safety concerns or the presence of prohibited waste, we may charge a call-out fee or reasonable waiting time, and we shall have no liability for any resulting delay or non-performance.
The Customer may cancel or amend a booking by contacting us using the details provided at the time of confirmation. We ask for at least 24 hours notice prior to the scheduled service time for cancellations or significant amendments.
If the Customer cancels with less than 24 hours notice, or if our team attends the property and is unable to complete the work due to the Customer not being present, lack of access, or a change in instruction that prevents completion, we may charge a reasonable cancellation or call-out fee.
We reserve the right to amend or cancel a booking in the event of circumstances beyond our reasonable control, such as severe weather, traffic disruption, vehicle breakdown, staff illness or other events of force majeure. In such cases, we will endeavour to contact the Customer as soon as possible to reschedule the service at a mutually convenient time. We will not be liable for any loss arising from such cancellations or delays, but any deposit paid for the affected service will be either applied to a new booking or refunded.
Rubbish Removal Harringay operates in accordance with applicable UK waste management legislation and duty of care requirements. We will transport and dispose of collected waste only at authorised facilities and will take reasonable steps to ensure that waste is handled responsibly and legally.
The Customer agrees not to present for collection any waste that is classified as hazardous, dangerous or otherwise controlled, including but not limited to asbestos, certain chemicals, medical waste, biological waste, pressurised containers, explosives or radioactive materials, unless we have expressly agreed in writing to handle such items and all legal requirements are satisfied.
We may ask the Customer to identify and segregate waste that requires special handling. If prohibited or unapproved hazardous waste is discovered in the load, we may refuse to collect it, request that it be removed from the load, or charge additional fees to manage and dispose of it in compliance with relevant regulations.
The Customer remains responsible and liable for any unlawful inclusion of prohibited or hazardous waste in the materials presented for collection, and for any fines, penalties, losses or costs that arise as a result.
The Customer must ensure that our team can safely park and have reasonable access to the property and waste. Any parking charges, permits or access fees required for our vehicles are the responsibility of the Customer unless agreed otherwise.
Our team will take reasonable care when moving waste through the property. However, the Customer should protect floors, walls, fixtures and fittings where necessary. We cannot accept liability for superficial damage to decoration, floor coverings or finishes that may occur as a result of moving bulky or heavy items through tight spaces, provided that our team has exercised reasonable skill and care.
If access is particularly restricted or if there are known structural or other vulnerabilities, the Customer must inform us in advance. We may refuse to carry out the service or may place conditions on the work if we consider that access poses a risk to safety or property.
Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited or excluded.
Subject to the foregoing, our liability to the Customer for any loss or damage arising out of or in connection with the Services, whether in contract, tort including negligence, breach of statutory duty or otherwise, shall be limited to the total price paid or payable by the Customer for the particular service in respect of which the claim arises.
We shall not be liable for any loss of profits, loss of business, loss of opportunity, loss of data, or any indirect, special or consequential losses arising from or in connection with the provision of the Services, even if such loss was foreseeable.
We will not be responsible for items that the Customer intended to keep but which were not clearly separated or identified from the waste to be removed. It is the Customer's responsibility to ensure that no valuable, sentimental or important items are mixed with the waste.
Any claims for damage to property or loss of items must be notified to us in writing as soon as reasonably practicable and in any event within seven days of completion of the service. We may require evidence, photographs or access to the property to investigate any such claims.
Rubbish Removal Harringay maintains appropriate public liability insurance and, where applicable, employer's liability insurance in line with industry standards. Details of cover can be provided upon reasonable request.
If the Customer is dissatisfied with any aspect of the Services, they should contact us promptly, providing full details of the issue. We will investigate the complaint and aim to respond within a reasonable timeframe with our findings and proposed resolution.
We will seek to resolve disputes amicably wherever possible. If a dispute cannot be resolved through our internal process, the parties may explore alternative dispute resolution options or take further action through the appropriate legal channels.
We will collect and use personal information provided by the Customer in order to manage bookings, deliver the Services, process payments and handle enquiries or complaints. We will take reasonable measures to keep such information secure and to use it only for legitimate business purposes in compliance with applicable data protection laws.
By using our Services, the Customer consents to the use of their contact details for communication related to their booking, including reminders, confirmations and follow-up messages. The Customer may request access to or correction of their personal data by contacting us directly.
We may update or amend these Terms and Conditions from time to time to reflect changes in law, industry practice or our business operations. The revised Terms and Conditions will apply to any new bookings made after the date of publication. For ongoing or pre-booked services, the version in force at the time of booking will generally apply unless otherwise agreed with the Customer.
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.
The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter, including any non-contractual disputes or claims.
If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court or competent authority, that provision shall, to the minimum extent necessary, be deemed deleted, and the remaining provisions shall continue in full force and effect.
No failure or delay by Rubbish Removal Harringay in exercising any right or remedy under these Terms and Conditions shall constitute a waiver of that or any other right or remedy, nor shall it prevent or restrict any further exercise of that or any other right or remedy.
The Agreement is between Rubbish Removal Harringay and the Customer. No other person shall have any rights to enforce any of its terms.
These Terms and Conditions, together with any written quotation or booking confirmation, constitute the entire agreement between the parties in relation to the Services and supersede any prior discussions, correspondence or arrangements.
